eastwind87 Posted March 20, 2009 Posted March 20, 2009 Hi all, I have a special situation here. I'm a Canadian citizen who has resided in the US for more than 10 years. I have not gotten a greencard, and have wandered from TD, H4, TN, to now H1-B status. I will be quitting my job relatively soon, and will need a F-1 visa to begin school again in the US. When I go through customs, will I have any issues? I know they don't like to grant visas to people who have expressed intent to stay in the US. After 10+ years, I really have no physical ties to Canada anymore - no property, no bank accounts, nothing... Is there a chance they'll reject my F1 application? Thanks in advance for your input!

In your situation , I am guessing that your last visa status was H1-B. which means you declared your intention to stay in the US and there is nothing wrong with that , your request/desire is still wihin the limits of the immigration law, I do not see you having any problem with a request for a student Visa . I think your may only have a problem if the immigration officer you are dealing with does not know the rules and regulations.. and this happens a lot .. you may want to use a busy border crossing which will have more qualified immigration officers to deal with any kind of request. I am not looking forward to going back to Canada for a student Visa . I do not anticipate any problem and you should not either .
