lawnoob Posted March 9, 2015 Posted March 9, 2015 Hi All, Here is the phrase: " The defendant expressly understands that his waiver is not predicated upon any promises, agreements, or understandings of any kind between party B and the defense in this case, and nothing herein shall be construed to preclude party B from proceeding against the defendant during or after the time period covered by this waiver. " I need to amend it to say: " The defendant expressly understands that his waiver is predicated only on the promise that Party B shall entertain plea offers, and that the trail will be set no earlier than May 5th but is otherwise not predicated upon any other promises, agreements, or understandings. It is only the terms set forth in this phrase that may preclude party B from proceeding against the defendant during or after the time period covered by this waiver. " Through clever wordplay, strategic punctuation, and grammar, it must seem to a quick reviewer that the clause states that the trial shall take place no later than May 5th, but in fact states that it should take place no earlier to someone well versed in English grammar rules. Could I please have some help? Many Thanks, Ramus, Roquentin, Dr. Old Bill and 3 others 6

Ramus Posted March 9, 2015 Posted March 9, 2015 I'm having flashbacks to my days working at my university's writing center, where all clients seemed to think, "It's your job to fix my essay, as I look at you as little more than a service worker slinging a red pen instead of a spatula." kurayamino, squankabonk and 1Q84 3
